Terms of service

1. Acceptance of the terms

By downloading, installing, or playing “Don Taco” (“the Game”), developed by Opacho Game Studio (“we”), you accept these Terms of Service (“Terms”). If you do not agree, you must not use the Game.

2. License to use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Game on your personal devices, in accordance with these Terms and the rules of the stores (Google Play, App Store, Nintendo eShop, etc.).

You may not:

• Copy, modify, distribute, sell, rent, or sublicense the Game.
• Reverse engineer, decompile, or attempt to extract the source code, except as permitted by law.
• Use the Game for illegal activities or activities that infringe third-party rights.

3. Account and registration

Some features (friends, leaderboards, cloud saves, session recovery) may require an account or player identifier.

• You are responsible for keeping your account confidential and for all activity under it.
• You must not share your account or allow third parties to use it.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. In-app purchases and virtual goods

The Game may offer purchases of virtual items, coins, packs, advantages, etc. (“Virtual Goods”).

• Virtual Goods have no real-world value, cannot be exchanged for money, and do not constitute real property; they are a license for use within the Game.
• Purchases are made through the stores (Google Play, App Store) and are subject to their terms and refund policies.
• We do not guarantee refunds except as required by law or store policies.
• We reserve the right to modify, remove, or adjust Virtual Goods, prices, and offers, with or without notice, as permitted by law.

5. Ads and rewarded videos

The Game may include ads and the option to watch videos for rewards.

• You agree to the display of ads managed by third parties (Google).
• Rewards for watching videos are granted under the rules of the Game; we reserve the right to adjust or remove these rewards.
• Advertising use is also subject to advertising providers’ policies.

6. Social features: friends and leaderboards

The Game may include:

• A friends system (sending/receiving requests, viewing progress, playing together, etc.).
• Global leaderboards and public rankings.

By using these features:

• You agree that certain information (player name, scores, achievements, avatar, etc.) may be publicly visible.
• You must not use these features to harass, threaten, deceive, spam, or infringe others’ rights.
• We reserve the right to moderate, hide, or remove content and to penalize users who violate these rules.

7. Cloud saves and session recovery

The Game may save your progress and data in the cloud to allow:

• Synchronization across devices.
• Session recovery after reinstalling or changing devices.
• We do not guarantee that cloud saves will be free of errors or data loss.
• We are not responsible for lost progress due to network, device, store, or third-party failures, except as required by law.
• You may request deletion of your data in accordance with our Privacy Policy.

8. Intellectual property

All Game content (code, graphics, music, text, characters, trademarks, etc.) is owned by Opacho Game Studio or its licensors and is protected by intellectual property laws.

These Terms grant you no rights to the trademarks, names, or logos of Opacho Game Studio or third parties.

9. Player conduct

You agree to:

• Not use cheats, hacks, unauthorized mods, exploits, or any method that alters the normal operation of the Game.
• Not engage in activities that harm servers, networks, or other players’ experience.
• Not publish illegal, offensive, discriminatory, or rights-infringing content.

Violations of these rules may result in suspension or termination of your access to the Game.

10. Limitation of liability

The Game is provided “as is” and “as available”, without express or implied warranties, except those that cannot legally be excluded.

To the fullest extent permitted by law:

• We are not responsible for indirect, incidental, special, or consequential damages arising from use of the Game.
• Our total liability, if any, will be limited to the amount you paid for the Game (if applicable) or a nominal amount if the Game is free.

11. Indemnification

You agree to indemnify and hold harmless Opacho Game Studio, its developers, and collaborators against claims, damages, or expenses (including reasonable legal fees) arising from your use of the Game or violation of these Terms.

12. Changes to the Game and the Terms

• We may update, modify, or discontinue the Game or parts of it at any time.
• We may change these Terms whenever we deem it necessary. The most recent version will be available at https://docs.google.com/document/d/e/2PACX-1vTCQX7TWY2-gWiSDFXJfL9bN5Ji2NUqz4SrTzDKTUm3wEuVAyhE2Cb17XoBfGT12Pvwa9ApxFejEYiN/pub and/or within the Game.
• Continued use of the Game after changes constitutes acceptance of the new Terms.

13. Termination

We may suspend or terminate your access to the Game, in whole or in part, at any time and for any reason permitted by law, including violations of these Terms.

14. Governing law and jurisdiction

These Terms are governed by the laws of Mexico. Any dispute will be resolved in the courts of Mexico, unless applicable law requires otherwise.

15. Store-specific provisions

• Apple App Store: You are responsible for complying with Apple’s policies; Apple is not a party to these Terms and assumes no responsibility for the Game.
• Google Play: Use of the Game is subject to the Google Play Terms and its payment and privacy policies.
